IU-Greens rejecting a motion court fees (22/01/2013)

As we all know recently passed in the House of Representatives, with only the support of the Popular Party, a law that raises new legal fees and has had the unanimous rejection of the opposition and of all professions related to justice: lawyers, prosecutors, and judges, as well as various associations, including the consumer and user.

The Spanish Constitution in Art.

24 guarantees that no citizen are defenseless.

This law is unconstitutional and therefore is an attack on the public, since part of it may not bring legal action to defend their interests if they lack sufficient resources.

This is the biggest attack on the rule of law has been committed since the transition.

We have to be sold as a way to lighten the justice as well go to trial only the really important things, but the real truth is that only serves to limit access to justice for people with fewer resources.

Pay if you are sued and you defend yourself.

WHO WILL HAVE PROBLEMS: any family with higher income (the whole family) to 1,100 euros:

· Want to defend an accusation

· Want to use a fine

· Want to use a job layoff

· Claim the municipality, region

· Want to make a division of property by inheritance or marital separation.

· Want to report malpractice and countless examples that are part of everyday life.

WHO WILL NOT HAVE ANY PROBLEM WITH litigate.

· Employers, especially large companies (tax deduction).

· Banks.

· Public administration (the state in all its forms)

· Individuals high income.

That is, to give examples that we can see nothing but turn on the TV or check social networks: evictions running banks, any celebrity or famous collapse of the courts if their tricks to have television audience or Mr. Barcenas (if it gets to judge the crime of the envelopes).

The full proposal that we, together with the PSOE translates into:

1.

Urge the Government of the Nation and in particular the Minister of Justice to take urgent steps to exclude citizens from paying court fees and ensure that no one sees limited their right of access to court for failing to meet the payment thereof.

2. - Move this agreement to the Ministry of Justice, the most representative associations of judges and prosecutors, the public schools of lawyers and solicitors, and organizations of Consumers and Users.

EXAMPLES:

1.

For workers who claim to work via establishing a levy in flagrant contradiction with the principles of free labor justice, and precisely when it is most imperative to judicial control.

500 euros is to charge a worker who has lost his job via trial before the Labour Court in any type of lawsuit and intends to seek in supplication, to which is added 0.5% of what is discussed (in dismissal, the sum of wages plus compensation processing).

if a worker earns a trial, your company has the possibility that maybe the reason he granted on appeal if not given it in the first and also the fee is deductible expense for the company as it is in the case of VAT and the cost of the lawyer, but the employee will have to comply with a judgment unfavorable social court because hardly going to pay a minimum 500 euros or 750 euros supplication minimum of cassation.

2.

ditto redemption request by a tenant.

the landlord is required to offer the option of buying the flat before selling it to others if you do not, you can buy the tenant filing this lawsuit.

cost rate: 300 € plus 0.5% of the fixed price paid for the floor.

eg.

floored € 300,000: € 1,800 fee.

3.

ditto division of the commonplace.

two co-owners of a property, for having inherited, or for having been married at the time, they want to divide.

cost rate: 300 € plus 0.5% fixed market value of the apartment.

eg.

floored € 300,000: € 1,800 fee.
