Juan Romero Garcia, Municipal spokesperson IU-Greens in the City Council regarding the Market Alhama installed in the Condado de Alhama Polaris World Resort

States:

Last Saturday, July 16 held at the Condado de Alhama an urban market, which according to leaflets distributed have the perspective to be held regularly on Saturday afternoon.

Royal Decree 199/2010 of 26 February, which regulates the practice of hawking or sedentary regarding MOBILE SALES AUTHORIZATION AND REGISTRATION OR SEDENTARY says:

Article 2.

Authorization scheme.

1.

Is up to municipalities to determine the location area for the exercise of the sale of mobile or sedentary, out of which may not be exercised business.

The street stalls sedentary or may not be at the entrances to public buildings, commercial and industrial establishments, or in locations that impede the access and circulation.

2.

For each specific site and for each of the modalities of itinerant or sedentary merchant intends to exercise, you must request an authorization to be granted by the municipality concerned.

In this regard it is noted that the City Council has a square and market ORDINANCE OF THE CITY Alhama de Murcia

Published in BORM of Saturday, December 13, 2008 says:

Article 1

In exercise of regulatory power granted by Article 4.1 a) of Law 7 / 85 Regulatory Basis of Local Government, the City of Murcia approved this Ordinance to regulate the provision of supply services, through municipal markets, by ensuring fair competition and provide adequate administrative supervision, the satisfaction of these needs, and the sale is made by traders outside of a permanent business establishment in the terms and conditions approved.

Article 109

1 .- This Chapter is to regulate the conditions, requirements and general terms must conform to the practice of the sale made by dealers outside of a permanent business establishment, in lots and open spaces and green areas, or public roads, places and dates variables in the municipality of Murcia.

2 .- Excluded from this Ordinance posts in the street 'own local and traditional festivals, book fairs and the like, as well as kiosks regulated in the corresponding Municipal Ordinance in places and under the conditions previously set by City Hall.

Article 110

1 .- Day of the week and situation.

It establishes the weekly market day on Tuesday, another day may be enabled when the match Tuesday holiday.

The City delimit the streets where to place the posts, is prohibited outside the perimeter of any facility authorized.

Except for the weekly markets, street trading is prohibited in the entire municipality.

2 .- Areas where the sale can be exercised.

The City Council will determine those places where newspapers can be held flea markets, based on the need for them.

The criteria for establishing new markets, are:

1 .- Level of existing commercial facilities in the municipality.

2 .- Adequacy of equipment to the structure and consumption needs of the population.

3 .- Density of population.

Therefore we understand that corresponds to the City Council to control and regulate the markets taking the rules cited above.

We understand that an uncontrolled proliferation of markets causes damage to established retailers in our town who pay their taxes and keep their establishments open throughout the year, life-giving work and economic activity to the municipality.

Moreover, street vending is set by two fundamental principles: 1 Providing service to residential areas where residents did not have the stable enough trade to meet their demand.

We believe that it is not the case.

2 ° Provide a job and a livelihood for residents who could not install their own establishment in a shop.

Neither is the case.

This situation does not benefit the commercial sector alhameño rather can impact a lack of control, security, hygiene and regulation, as opposed to what is intended with our Market Order.

Furthermore, it undermines and discourages the employer that respects its customers, investing in your business, and that makes people grow.

One of the arguments for the authorization of such macro-developments was that generate wealth for the people, as residents would travel to shop at Alhama involves the creation of jobs.

With this type of action we take wealth to the development without impacting on the welfare of Alhameños.

Therefore we ask the Councillor of Commerce, the Mayor or from whom the following information I documentation:

Did you know the City Council the installation of this event?

Have you applied for legal reporting for this purpose?

Where reports have been made legal copies of them.

Have you any fees charged by the City Council the installation of these positions?

If so economic reports of the fees charged for such an event broken.

Is this event was a licensed activity, since its purpose was a commercial activity as stated in the leaflets and posters disseminated?

Who were the organizers and beneficiaries of this market?

If not, why not ban such activity?

Did the organizer full permissions to perform the various musical performances and games, under current legislation?

A copy of the request of the organizer and copies of reports or permissions given by the City Council or other agencies.

What municipal police officers and Civil Guard covered the event?

How much was this device to city coffers?
