The City Council is responsible for 100% of the public contracts until March 31 (30/03/2020)

Article 34 of Royal Decree Law 8/2020 of March 17, established the automatic suspension of public service and supply contracts that have ceased to be provided from that day until they can be resumed.

The City Council of Alhama de Murcia, despite the entry into force of this rule, has made a great economic effort to keep all contracts active until March 31, 2020, paying 100% of its cost, both to companies and to workers, although some of them have been suspended since day 17.

The Consistory has transferred this circumstance to the contractor companies affected, which occurs due to the closure of municipal facilities and services, as a measure in the face of the health crisis caused by the COVID-19 pandemic.

The City Council wants to clear doubts and send a message of tranquility, both to companies and their employees due to this situation, derived from the declaration of the state of alarm and contained in article 208 of Law 9/2017 on Public Sector Contracts.

Therefore, it states that, after the suspension of the contracts in force or the initial act, the will is to resume them as soon as the State lifts the measures, but also the intention to recover, if possible, a part of the services not provided.

In addition, in strict application of the contracting regulations, the Alhama City Council informs of its obligation to pay the contractor for the damages and losses actually suffered by the contractor during the suspension period, upon request and reliable proof of its reality, effectiveness and amount, attending to the assumptions contained in the Royal Decree.

Including personnel costs, either derived from contract suspensions, or from those labor contracts assigned to the service that the company considers not to suspend.

The suspension of public sector contracts, in accordance with this article, does not constitute in any case a cause for their termination and, once this situation has subsided, the City Council will notify the companies so that they can return to their normal activities.

As an alternative to confinement, new services have been contracted, following the guidelines for the psychological management of the quarantine for the coronavirus, via online, to provide content to the #AlhamaSeQuedaEnCasa program, which offers a wide range of multimedia content every day for all family on municipal social networks.
